Welcome to K-Bot Factory. By accessing our website (https://kbot.jevi.es) and utilizing our services, you agree to be bound by the following Terms of Service ("Terms"). Please read them carefully.

1. General Provisions

A. Agreement

This Agreement is a legally binding contract between you ("User," "you," or "your") and Jesús Vílchez ("K-Bot Factory," "we," "us," or "our"), an individual developer based in Spain. By using our Service, you confirm that you have read, understood, and agree to these Terms.

B. Nature of Service

K-Bot Factory provides a Programming and Deployment Service. We offer a platform where users can configure specific features ("Addons"), branding, and languages for Discord bots. K-Bot Factory then builds, deploys, and hosts these bots on behalf of the user. You acknowledge that you are purchasing a service and a right to use our infrastructure, not the underlying software code itself.

2. Definitions

  • Service: The programming, configuration, deployment, and hosting of Discord bots provided via https://kbot.jevi.es.
  • User: Any individual or entity that registers an account or purchases a service from K-Bot Factory.
  • Addons: Specific functional modules selected by the User to be included in their custom bot.
  • Intellectual Property (IP): All software code, logic, algorithms, infrastructure, and branding related to the K-Bot Factory platform and the bots generated.

3. Eligibility and Age Restriction

The Service is strictly intended for users aged 13 years or older. By using this Service, you represent and warrant that you meet this age requirement. If we learn that a user under 13 has provided personal data or is using the service, we will terminate the account in compliance with GDPR and COPPA regulations.

4. Intellectual Property and Licensing

A. Ownership

K-Bot Factory retains exclusive ownership of all software code, source files, databases, and technical infrastructure used to create and host the bots. Nothing in these Terms constitutes a transfer of intellectual property rights from K-Bot Factory to the User.

B. Limited License

Upon successful payment, K-Bot Factory grants the User a revocable, non-exclusive, non-transferable, limited license to utilize the Service and the resulting Discord bot for their community. The User may not:

  • Decompile, reverse-engineer, or attempt to extract the source code of the bot.
  • Resell or redistribute the Service or the bot as a standalone product.
  • Modify or remove any "Powered by K-Bot Factory" credits or proprietary notices within the bot's interface, unless explicitly authorized by K-Bot Factory.
  • Perform any other action that may damage the reputation of K-Bot Factory.

5. Disclaimers & Non-Affiliation

A. Discord Inc.

K-Bot Factory is NOT affiliated with, endorsed by, sponsored by, or otherwise associated with Discord Inc. Users are solely responsible for ensuring their use of our bots complies with the Discord Terms of Service and Developer Terms.

B. Kpop Industry

K-Bot Factory is a technical service provider and is NOT affiliated with, endorsed by, or associated with any Kpop entertainment agencies (e.g., HYBE, SM, YG, JYP), artists, or music groups. Any Kpop-related themes, names, or imagery configured by the user are intended for community and entertainment purposes under the principles of "Fair Use" or "Nominative Fair Use." The User assumes all responsibility for any content they upload or configure.

6. Payments, Billing, and Refunds

A. Payment Processing

All payments are processed securely through Stripe. K-Bot Factory does not store your credit card information.

B. Fees

Users agree to pay the fees associated with their chosen configuration (Initial Setup Fee) and any recurring maintenance/hosting fees as specified during the checkout process.

C. Refund Policy

Due to the nature of our Service (which involves manual labor, custom programming, and immediate server resource allocation), refunds are only available if requested before the deployment process of the bot has begun. Once the bot has been built and deployed to a server, the service is considered "consumed," and no refunds will be issued. For more information, please refer to our Refund Policy.

7. User Responsibility and Conduct

The User is solely responsible for:

  • The management and moderation of the Discord servers where the bot is installed.
  • The content, commands, and interactions facilitated by the bot within their community.
  • Ensuring that their use of the bot does not violate any local laws or third-party rights.

8. Limitation of Liability

To the maximum extent permitted by Spanish law, K-Bot Factory and Jesús Vílchez shall not be liable for:

  • Any direct, indirect, or consequential damages resulting from the use or inability to use the Service.
  • Discord-side actions: This includes server bans, bot deactivations by Discord, or account suspensions resulting from the User’s management of the bot.
  • Service interruptions due to third-party hosting issues or Discord API changes.
  • The total liability of K-Bot Factory for any claim shall not exceed the amount actually paid by the User for the Service.

9. Term and Termination

  • By the User: You may stop using the Service at any time by cancelling your subscription or removing the bot from your server.
  • By K-Bot Factory: We reserve the right to suspend or terminate your access to the Service without notice if:
    1. You violate these Terms.
    2. You fail to pay the required maintenance fees.
    3. Your bot is used for illegal activities or violates Discord’s policies.
    4. You are found to be in violation of any applicable laws or regulations.
    5. Other reasons as determined by K-Bot Factory in its sole discretion.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.

11. Modifications

K-Bot Factory reserves the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date at the top of this document. Continued use of the Service after changes constitutes acceptance of the new Terms.
